What this policy covers, and what it does not
This policy is about this website. It explains what happens to information collected when you visit keelyrodrigueztherapy.com, read a page, or book a consultation.
It is not the policy that governs your therapy record. If you become a client, the confidentiality of everything you tell me and everything I write is governed by a separate set of rules: Texas Health and Safety Code Chapter 611, which protects mental health records, Texas Health and Safety Code Chapter 181, and the informed consent and practice policies you sign before your first session. Those documents are more detailed and more protective than this one, and they control.
This page is not a HIPAA Notice of Privacy Practices. Those are two different documents with two different jobs.
Please do not send me private information through this website
Email, web forms, and text messages are not secure. Anything you send that way can be intercepted, forwarded, or stored somewhere neither of us controls.
Please do not use this site or ordinary email to send details about your health, your symptoms, your history, medications, a diagnosis, or anything else you would not want read by a stranger. Tell me you would like to talk. We will find a secure way to have the conversation.
If you send that kind of information anyway, I will treat it carefully and store it appropriately. I just cannot promise it was safe in transit.
What this website collects
Information you give me. If you book a consultation through my scheduling service, you provide your name, email address, phone number, your time zone, and whatever you choose to write in the optional fields. If you email or call, I have whatever you put in that message.
Information collected automatically. Like most websites, this one records basic technical information when you visit: IP address, browser and device type, operating system, the pages you looked at, how long you stayed, and the site that referred you. This is collected through my website host and, where enabled, Google Search Consule. I look at it in the aggregate to understand which pages are useful. I do not use it to identify individual visitors.
Cookies. This site uses cookies, which are small files stored by your browser. Some are necessary for the site to work. Others support analytics. You can block or delete cookies in your browser settings, and the site will still work, though some parts may behave differently.
Advertising and tracking pixels. I do not run advertising trackers or social media pixels on this site. If that ever changes, this policy will say so before it happens, not after.
Why I collect it
To operate and secure the website. To respond to you when you reach out. To schedule and confirm consultations. To understand, in the aggregate, which content people find useful so I can write more of it. To meet legal and professional obligations.
That is the entire list. I do not use website information to build a profile of you, and I do not use it to target advertising.
Who else touches this information
I use a small number of outside services to run the practice, and they process information on my behalf:
My website host, Squarespace, which stores the site and its server logs
My scheduling service, Calendly, which handles consultation bookings
My email provider, which delivers and stores email,Gmail.
Google Search Console, where enabled, for aggregate site statistics
Each of these has its own privacy policy governing what it does with information you enter there. I choose vendors with care and limit what they receive to what the job requires.
I do not sell your personal information. I do not sell sensitive personal information. I do not share it with data brokers or advertisers. I have never done this and I do not intend to.
Beyond the vendors above, I disclose information only when you ask me to in writing, or when the law requires it.
Electronic disclosure of health information
Texas law requires me to tell you that protected health information about you may be subject to electronic disclosure, and to obtain your authorization before disclosing it electronically, except where the law provides otherwise.
This notice is given under Texas Health and Safety Code Section 181.154. Where authorization is required, I obtain it separately and in writing before the disclosure.
How long information is kept
Website analytics and server logs are kept for a limited period and then discarded or aggregated so they no longer identify anyone.
Consultation booking records are kept as long as needed to schedule and follow up, and then removed unless you become a client.
Clinical records, if you become a client, are kept for the period Texas law requires. Texas requires health care records to be retained for at least seven years after the last treatment for adults, and longer for minors. That retention is governed by your signed practice policies, not by this page.
How information is protected
The site uses encryption in transit. Practice records are kept in access-controlled, password-protected systems on encrypted devices. I limit who can reach anything, which in a solo practice means me.
No system is perfectly secure, and I will not tell you otherwise.
If a breach happens, Texas law requires me to notify affected Texas residents without unreasonable delay and no later than 60 days after I determine a breach occurred, and to notify the Texas Attorney General within 30 days if the breach affects 250 or more Texas residents. Texas Business and Commerce Code Section 521.053. I will follow that, and I will tell you what happened rather than the minimum I can get away with.
Your choices
You may ask me what information I hold about you, ask me to correct it, or ask me to delete website information about you. Email keely@keelyrodrigueztherapy.com and I will respond within 30 days. Some records I am legally required to keep, and I will tell you plainly if that applies.
If you use an EHR portal as a client and request your record electronically in writing, Texas law gives me 15 business days to provide it. Texas Health and Safety Code Section 181.102.
You can block cookies in your browser. You can unsubscribe from any email list I run using the link in the email.
Who this site is for
This website and the services on it are directed to residents of Texas. I am licensed in Texas only and can provide counseling only to people physically located in Texas.
I do not target or offer services to people outside the United States, and I do not knowingly collect information from people located in the European Union or the United Kingdom.
Children
This site is not directed to children under 13 and I do not knowingly collect their information. If you believe a child has provided information through this site, contact me and I will delete it.
Requesting your records, or filing a complaint
Instructions for requesting your health care records, contacting my licensing board, and filing a consumer complaint are on my Your Rights page, as required by Texas Health and Safety Code Section 181.105.
Changes
If I change this policy, I will update the effective date above. If a change is significant, I will say so on the page rather than quietly replacing the text.
